The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.356/2025 registered at Police Station – Pulgaon, District – Durg (C.G.) for the offence punishable under Sections 309(6), 311, 109 of Bharatiya Nyaya Sanhita, 2023 and Sections 25, 27 of Arms Act. 2. The case of the prosecution, in brief, is that the complainant lodged a report at the concerned Police Station alleging that on 29.08.2025 at about 5:21 PM, an unknown person looted a cash amount of Rs.500/- from him with the help of a knife at Village Khapri near the Panchayat PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.04.10 16:48:31 +0530 2 Bhawan. Based upon the said complaint, the police registered a case under Sections 309(6), 311, and 109 of the B.N.S., and Sections 25 and 27 of the Arms Act against unknown persons. During the course of investigation, the police arrested the present applicant on the basis of a memorandum statement. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submitted that the police has not seized any article from the possession of the applicant and he has falsely been implicated in connection of this crime only on the basis of memorandum of statement of co-accused Mohd. Alam. Only on the basis of merely suspicious, the applicant has falsely been implicated in connection of this crime without taking proper investigation and without any sufficient material. He also submit that the applicant has two previous criminal antecedents, the charge-sheet has been filed in this case and the applicant is in jail since 17.10.2025 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 4. On the other hand, the learned State counsel opposed the bail application, submitting that the charge-sheet has already been filed. She further contended that the applicant is alleged to have assaulted the injured with a knife, inflicting a stab wound on the abdomen, which has been found to be grievous in nature and dangerous to life. Further, the applicant has two previous criminal antecedents. Therefore, it is submitted that the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Taking into consideration the facts and circumstances of the case, nature 3 and gravity of allegation levelled against the applicant and the fact that the applicant is alleged to have assaulted the injured with a knife, inflicting a stab wound on the abdomen, which has been found to be grievous in nature and dangerous to life, further, the applicant has two previous criminal antecedents, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant - Kunal Singh @ Tillu involved in Crime No.356/2025 registered at Police Station – Pulgaon, District – Durg (C.G.) for the offence punishable under Sections 309(6), 311, 109 of Bharatiya Nyaya Sanhita, 2023 and Sections 25, 27 of Arms Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
