Let affidavit-of-service, as filed in Court, be kept on record. 2. The petitioner has challenged the Memorandum dated August 12, 2026, by which the list of eligible and willing Fire Operators is being considered for the promotion to the post of Leader. 3. The challenge of the petitioner is that on an earlier occasion the petitioner had allegedly been deprived of such promotion under the Scheduled Tribe category. The earlier process has been challenged by the petitioner and is pending before the West Bengal Administrative Tribunal being O.A. No. 768 of 2023. 4. The petitioner has, however, participated in this process initiated by the Memorandum dated August 12, 2026. His participation is without prejudice to his rights and contentions as espoused in O.A. No. 768 of 2023. 2 5. This writ petition is disposed of recording the fact that the participation of the petitioner in the process initiated by the Memorandum dated August 12, 2026 is without prejudice of his rights and contentions in the pending O.A. before the West Bengal Administrative Tribunal. 6. There will be no order as to costs. 7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
