As per the office note, the matter is listed for order on default(s) for non compliance of this Court order dated 01.08.2023, whereby the appellant was directed to take appropriate step for bringing the legal representatives of deceased appellant on record. It is noted that sufficient opportunity has already been granted to the appellants and the order dated 01.08.2023 has not been complied with. 2. Earlier the case was listed on 28.06.2023, however, none had appeared nor any representation is made on behalf of the Appellants, therefore, an order for issuance of SPC was passed. Even today, when the case is called twice, none appears nor any representation is made on behalf of the appellants. 3. The matter has consequently abated on account of failure to bring the legal representatives of the deceased respondent on record within the prescribed period. No sufficient ground is made out for granting any further time. 3 4. Accordingly, the appeal stands dismissed as abated for non- compliance with the order dated 01.08.2023 and for failure to take necessary steps to bring the legal representatives of the deceased respondent on record. 5.
