Learned advocate for the petitioner submits that the petitioner has been foisted with the present criminal case. State has produced the case diary. I have taken into account the injury report as well as the statement of the victim under section 183 of the BNSS. Although, the statement of the victim under section 183 of the BNSS named the present petitioner, but, such statement was recorded on 06.11.2025. So far as the statement
2 recorded on 23.10.2025, it reveals the names of two ladies but the name of the present petitioner was missing. It has been informed that charge-sheet has already been submitted in connection with the instant case. Having considered same, I am of the view that custodial detention of the present petitioner is unwarranted. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Firoj Malitya] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 2787 of 2026 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
