1. The petitioner is before this Court seeking for the following reliefs: a. Call for Records from the Respondent No.3, Chamarajanagar Institute of Medical Sciences Institution in respect of the Tender dated 3/11/2025 for tender bearing No.¹ªÀiïì/ mÉAqÀgï/ºÉÆ.UÀÄ/172/2024-25 vide Annexure-A, Tender dated 28/10/2025 for tender bearing No.¹ªÀiïì/mÉAqÀgï/ºÉÆ.UÀÄ/109/2024-25 Vide Annexure- A1 and Tender dated 10/11/2025 for tender bearing No.¹ªÀiïì/mÉAqÀgï/ºÉÆ.UÀÄ/ 204/2024-25 Vide Annexure-A2.

b. Issue writ of certiorari or order or direction in the nature of writ quashing the rejection of the tender submitted by the Petitioner as available on the E- Procurement Portal vide Annexure-C, C1 and C2 respectively issued by the 3rd Respondent - Dean and Director Chamarajanagar Institute of Medical Sciences bearing No.DME/2025-26/SE0597, DME/2024-25/SE0423/CALL-2 and DME/2024- 25/SE0436/CALL-2. c. Issue a writ of Mandamus or order or direction directing the Respondent No.3, Dean and Director Chamarajanagar Institute of Medical Sciences to consider the tender bid of the Petitioner and to consequently open the Financial Bid of the Petitioner, in the interest of justice and equity. d. Pass such other order as this Hon'ble Court deems fit to grant based on the facts and circumstances of the case, including the cost of the proceedings, in the ends of justice and equity. 2. An affidavit of the Director and Dean, Chamarajanagar Institute of Medical Sciences, Chamarajanagar has been filed, which reads as under;
AFFIDAVIT ON BEHALF OF THE 3RD RESPONDENT
I, Dr. Devaki R.N., W/o Dr. Rangaswamy M., aged about 54 years, Director and Dean, Chamarajanagar Institute of Medical Sciences, Chamarajanagar, presently at Bangalore, do hereby solemnly affirm and state on oath as follows:
1. I am the Director and Dean of Respondent No.3
and am well acquainted with the facts and records of the case. I am duly authorised and competent to swear to this affidavit on behalf of Respondent

2. I state that Respondent No.3 is a Government Medical College and Teaching Hospital providing tertiary healthcare services and catering to a substantial patient population. The tenders in question relate to engagement of outsourced manpower including Staff Nurses, Group-D personnel, Laboratory Attenders and Drivers, whose services are indispensable for the day-to-day functioning of the institution. 3.
I state that, in the proceedings held between Chamarajanagar Institute of Medical Sciences and the Directorate of Medical Education, certain deficiencies have been noticed in the tender process relating to the subject tenders. 4. I state that, upon consideration of the proceedings and in view of the deficiencies noticed in the tender process, Respondent No.3 has decided to withdraw the subject tender process and take appropriate further action in accordance with law. 5. I therefore respectfully pray that this Hon'ble Court may be pleased to permit Respondent No.3 to withdraw the subject tender process and take appropriate further action in accordance with law. Wherefore, it is prayed that this Hon'ble Court may be pleased to take this affidavit on record and pass appropriate orders permitting Respondent No.3 to withdraw the subject tender process and proceed further in accordance with law, in the interest of justice and equity. On the basis of the said affidavit, Sri.Reuben Jacob., learned Additional Advocate General would submit that respondent No.3 has decided to withdraw the tender process and reissue a fresh tender notification. His submission is that since interim orders which had been passed, it should not be held against respondent No.3, if a fresh tender is issued. 4. The apprehension on the part of the respondents are unfounded, inasmuch as the interim order had been issued only in respect of the current tender process. Since the tender process is being withdrawn and a new tender is going to be issued, the interim order would not be applicable thereto. 5.
Reserving liberty to the petitioner and anyone else to participate in the said tender as and when floated, the petition stands disposed in terms of the affidavit which has been filed that the tender having been withdrawn, the petition has been rendered infructuous.
