JUSTICE K.MANMADHA RAO ORAL ORDER Heard Sri.G.B.Nandish Gowda, learned counsel for the petitioner. 2. This writ petition is filed seeking a direction to the Court of VI Additional Principal Judge, Family Court, Bengaluru (hereinafter referred to as the ‘Family Court’) to expeditiously dispose of the petition in M.C.No.5328/2022 which is pending on its file. 3. Learned counsel for the petitioner submits that petitioner is the husband of the respondent. The petitioner - 3 - HC-KAR NC: 2026:KHC:20879 WP No. 8984 of 2026 filed M.C.No.5328/2022 seeking for dissolution of marriage. It is submitted that, the Family Court on 21.08.2023 adjourned the matter for further chief of PW.1 and on 15.11.2023 further chief examination of PW.1 was record and the matter was adjourned to 19.12.2023 for cross-examination of PW.1. Since 19.12.2023, the respondent is not co-operating with the Court to dispose of the case, the petitioner filed petition in W.P No.24922/2025 to dispose of M.C.No.5328/2022 expeditiously. This Court, vide order dated 19.08.2025 disposed of the writ petition with a direction to the petitioner to review his request after six months. 4. The learned counsel further submitted that the respondent is not showing any interest in prosecuting the case and for one or the other reason, the respondent is dragging the proceeding since 2022. Being aggrieved by the same and also in view of the direction issued by this Court, this writ petition is filed. - 4 - HC-KAR NC: 2026:KHC:20879 WP No. 8984 of 2026 4. Record discloses justification in the submission that is made by learned counsel for the petitioner. Therefore, this Court considers desirable to dispose of the writ petition and give directions. Hence, the following: ORDER (i) Writ petition is disposed of. (ii) The Court of VI Additional Principal Judge, Family Court, Bengaluru is directed to take all steps for disposal of M.C.No.5328/2022 as expeditiously as possible. (iii) This Court is not issuing the notice to the respondent as no adverse orders are passed and disposed of the petition in the interest of both the parties.
