Santra …for the petitioner In this application the petitioner has prayed for a direction upon the Executing Court for expeditious disposal of the proceeding being Misc. Execution Case No.142 of 2023 arising out of CNS No. 423 of 2019. Being aggrieved by the inordinate delay caused in disposal of the said execution case, learned Counsel for the petitioner submits that he filed the said execution case on 19.10.2023 and since then it is pending for disposal. Accordingly, he prayed for necessary direction. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having considered submission made on behalf of the petitioner, the instant application being CRR 1192 of 2025 is hereby disposed of with a direction upon the Court below to make his best endeavour for expeditious disposal of the proceeding and 2 to make his best effort to conclude the said execution proceeding preferably within a period of 3(three) months from the next date of hearing.
