Accused in S.C.No.1268 of 2023 pending before the Court of LXVII Additional City Civil & Sessions Judge, Bengaluru arising out Crime No.118 of 2023 registered by Mahalakshmipuram Police Station, Bengaluru City for offences punishable under Sections 504, 506 and 307 of IPC is before this Court in this position filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that, at crime stage, petitioner who is arraigned as accused no.1 in the charge sheet was arrested on 25.05.2023 and subsequently he was granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.9635 of 2023 vide order dated 16.10.2023. After the case was committed to the jurisdictional Sessions Court, the petitioner had not appeared before the Trial Court on the regular dates of hearing and therefore, coercive steps were taken against him and his presence was secured on - 3 - HC-KAR CNR: KAHC010528732026 NC: 2026:KHC:47003 CRL.P No. 11620 of 2026 13.01.2026 and on the same day he was remanded to judicial custody. 4. It is not in dispute that petitioner has no other criminal antecedents. Though he was released on bail in the present case, thereafter for the reason that he had not appeared before the Trial Court on the regular dates of hearing, he is now remanded to judicial custody. For the mistake committed by the petitioner, he has been sufficiently punished. He has undertaken to co-operate before the Trial Court for speedy disposal of the case. Under the circumstances, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.1268 of 2023 pending before the Court of LXVII Additional City Civil & Sessions Judge, Bengaluru arising out Crime No.118 of 2023 registered by Mahalakshmipuram Police Station, Bengaluru City for offences punishable under - 4 - HC-KAR CNR: KAHC010528732026 NC: 2026:KHC:47003 CRL.P No. 11620 of 2026 Sections 504, 506 and 307 of IPC, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
