Mr. Tarique Quasimuddin, Adv. Mr. Abbas Ibrahim Khan, Adv. ..for the respondent nos.1 to 4 & 11
The Court: The petitioner has preferred the present petition under Section 29-A(5) of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the Arbitral Tribunal for conclusion of the arbitral proceedings and publication of the arbitral Award.
Learned Counsel for the petitioner contends that the sole Arbitrator was appointed by this Court vide order dated 24.11.2022 to adjudicate the disputes between the parties. With the consent of the parties, an extension for a period of six months was granted on 01.02.2024. This Court vide orders dated 19.02.2025 & 17.12.2025 extended the mandate of the Tribunal by six months and eight months respectively.
2
Learned Counsel for the petitioner submits that 40 meetings of the Tribunal have been held and that the matter is presently at the stage of final
arguments.
Learned Counsel for the respondent states that he has no objection to the extension of the mandate of the Arbitral Tribunal. Upon consideration of the submissions of the parties and the materials placed on record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned sole Arbitrator in conducting the arbitral proceedings. Having regard to the advanced stage of the arbitral proceedings and in the interest of justice, the mandate of the learned Arbitral Tribunal is further extended for a further period of four months from today. The learned sole Arbitrator is requested to make all reasonable endeavours to conclude the proceedings and publish the arbitral award within the extended time period. With the aforesaid directions, the present petition stands disposed of.
