Mr. Pradeep Lohani, learned AGA with Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Suraj Singh, who has been accused in FIR No.140 of 2025, under Sections 80 (2) of BNS, 2023 at Police Station Dineshpur, District Udham Singh Nagar. 4. According to the prosecution story, on 16.07.2025, the plaintiff, Mrs. Anita, filed a First Information Report at the Dineshpur Police Station, stating that her daughter, Pooja, had been married to the Applicant/accused, Suraj, approximately one year earlier. Since the marriage, the Applicant/accused and her daughter's father-in-law had been harassing her for insufficient dowry, and that the Applicant/accused would frequently assault her under the influence of drugs. On 09.07.2025, the applicant/accused, under the influence of drugs, severely assaulted her daughter, causing her to consume poison. The applicant and her family members took her to “Sushila Tiwari Hospital, Haldwani”, for treatment, where she died during treatment on 14.07.2025 at 3:00 p.m. 5. Learned counsel for the Applicant submits for the consideration of the bail that the Applicant has falsely been implicated in the present matter and the Applicant has no criminal history. The Applicant is in jail since 21.09.2025. She further submits that the present Applicant and the deceased were in love with each other and on 15.10.2024, they got married and there was no demand of dowry. 6. Learned State Counsel has vehemently opposed the bail application of the Applicant with a submission that the deceased - Pooja died within one year of the marriage in unnatural circumstances in the legal custody of the present accused/Applicant, and the Applicant may not be enlarged on bail. 7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed. It is directed that the Applicant - Suraj Singh, who has been accused in FIR No.140 of 2025, under Sections 80 (2) of BNS, 2023 at Police Station Dineshpur, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
