JUSTICE ASHOK KUMAR JAIN Order 25/02/2026 1. Instant writ petition is preferred by petitioner with following prayer: “I. By an appropriate writ, order or direction to respondents to consider the candidature of the petitioner for direct recruitment as Teacher Grade [2026:RJ-JP:8736] (2 of 3) [CW-6064/2022] III level-2 for the subject- Social Study in Sportsman Quota as per Advertisement dated (Annexure-1). II. The non petitioners may kindly be directed to appoint the petitioner as earlier provisional selected list dated 11-01-2021 (Annexure 2&4) wherein she was placed at serial Number 909 as WL no. 4030. III. The respondent may be directed to compliance the letter dated 23-03- 2022(Annexure 11) looking to the national certificate of sports, further She may also be considered under reserved category for sportsperson, which has to be filled as per sports quota which is reserved 2% seats out of 2900 seats to be filed with this category. IV. The respondents may be directed to give all the benefits from the date of appointment of similarly situated other candidates.” 2. Learned counsel for petitioner submits that the controversy raised herein is already settled by judgment of Division Bench at Principal Seat, Jodhpur in DB Special Appeal Writ No. 111/2025 titled as Garvit Vyas Vs. State of Rajasthan and Ors. decided on 01.08.2025 and considered by this Court as well in SB CWP No. 12634/2025 titled as Jitendra Vs. State of Rajasthan and Ors. On 07.10.2025, therefore the writ petition be disposed of in light of judgment in case of Garvit Vyas Vs. State of Rajasthan and Ors. (supra). [2026:RJ-JP:8736] (3 of 3) [CW-6064/2022] 4. Learned counsel for respondent submits that subject to verification of veracity of facts as claimed by the petitioner, the writ petition be disposed of. 5. Having considered aforesaid, the writ petition is disposed of in light of case of Garvit Vyas Vs. State of Rajasthan and Ors. (supra) and respondents are directed to conduct an inquiry in relation to the certificates as submitted by petitioner as early as possible preferably within a period of 8 weeks from date of receipt of copy of this order. If petitioner is found to be an outstanding sports person then only candidature of petitioner be strictly considered in accordance with merits for the category for which the petitioner for filed an application. 6. In case of deviation, the respondents are under an obligation to decide the issue with a reasoned and speaking order within a period of 30 days after concluding the inquiry. 7.
