In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
And In the matter of : Sahidul Miya @ Sahidul Islam & Ors.
……Petitioners.
Ms. Esha Acharya,
Ms. Ipsita Saha, ……for the Petitioners.
Mr. Panchali Deb Sikder (Nag),
Mr. Gobindo Ghosh,
Mr. Debabrata Rai,
……for the State.
1. The petitioner nos. 1 and 2 are the parents-in-law and the petitioner nos. 3 and 4 are the brothers-in-law of the victim lady who committed suicide within seven months of marriage. The allegations are under Sections 498A/304B/ of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
2. The petitioners say that they have no role to play in the alleged crime. The principal accused being the husband of the victim is in custody. They pray for pre-arrest bail.
3. Learned State counsel shows me statements of witnesses recorded under Section 180 of the B.N.S.S. They specifically implicate all the petitioners as having meted out physical and mental torture to the victim. The reason seems to be that they wanted the victim to bring more money from her parents.

4. On an overall assessment of the facts and circumstances of the case and considering the material- on-record, I am not inclined to allow this application.
5. CRM (A) 640 of 2026 is dismissed. (Arijit Banerjee, J.)
