1. Affidavit of service filed on behalf of petitioner is taken on record. 2. By presenting this writ petition prayer is made thereby directing concerned police authorities to take steps which would permit the petitioner to stay at the premises where petitioner’s wife and son reside. It is also submitted that complaint was lodged on 25th July, 2026 alleging petitioner was driven out of residence forcibly by his son and according to petitioner complaint dated 25th July, 2026 did not yield result prompting the petitioner to approach this Court with the present writ petition seeking direction upon the concerned police authorities. 3. Mr. Roy Chowdhury, learned Additional Government Pleader representing State respondents has filed a communication dated
2 20th August, 2026 of Inspector-in-Charge, Malipanchghora Police Station, Howrah and same is taken on record. 4. It is disclosed in the communication dated 20th August, 2026 that there is a long standing property dispute and petitioner is alcohol addicted person. Number of occasions petitioner was taken to rehabilitation centre and in support of same a document issued by Sneh Nir Detoxification and De-Addiction Centre for Drug and Alcohol dated 9th June, 2013 is relied upon which is at page 38 of writ petition. 5. It is also disclosed in the communication that a criminal prosecution has been initiated against the petitioner being Malipanchghora Police Station Case No. 214 of 2026 dated 20th July, 2026 under certain provisions of BNS and while investigating the said case it was found that petitioner is an addicted person and mass petition was received by police authority from local residents. 6. However, submission is made by the learned advocate representing petitioner that petitioner has right over the premises in question. Therefore, petitioner may be permitted to stay at the said premises. 3

Since it is alleged by petitioner by lodging complaint dated 25th July, 2026 that he has been driven out of his residence by sheer force and coercion at the instance of his son, concerned police authority shall make an endeavour for petitioner’s stay at the premises in question and to see that petitioner shall not cause inconvenience to other persons who are staying at the said premises.
