JUSTICE T.P.VIVEKANANDA - 3 - HC-KAR CNR: KAHC010719312025 NC: 2026:KHC:45526 WP No. 33487 of 2025 ORAL ORDER Petitioner is before this Court seeking for issue of writ of mandamus to respondent No.2 to consider the representation dated 10.03.2025, whereby, the petitioner has complained that respondent No.4, who is an employee of respondent No.3 is also an office bearer of respondent No.5, which is contrary to the service conditions and therefore, requested to take action against respondent No.4. 2. Learned counsel for respondent No.4 has filed statement of objections producing various documents and contends that the writ petition is not maintainable and liable to be dismissed, as the petitioner has no locus standi to complain to respondent No.3. He further contends that on the very same complaint/allegation a disciplinary inquiry was initiated and respondent No.4 was imposed with the punishment of stoppage of one annual increment with cumulative effect, therefore, submits that the prayer in the writ petition has become infructuous. 3. Taking note of the aforesaid subsequent developments and more specifically, the order of punishment at - 4 - HC-KAR CNR: KAHC010719312025 NC: 2026:KHC:45526 WP No. 33487 of 2025 Annexure-R9 dated 29.11.2025, the writ petition is disposed of as having become infructuous. The disposal of this writ petition with the aforesaid observations would not come in the way of respondent No.4 challenging the punishment order dated 29.11.2025 at Annexure-R9, in the manner known to law.
