(ORAL) 1. The present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 439 Cr.P.C.) read with Section 528 of the BNSS, 2023 (corresponding to Section 482 Cr.P.C.) seeking grant of interim bail for a period of eight weeks to the petitioner in case FIR No.80 dated 17.04.2026 registered under Sections 21(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station ANTF, District Mohali. 2. Learned counsel for the petitioner submits that the wife of the petitioner has delivered a child on 07.08.2026 and is in dire need of the petitioner's care and attention. He further submits that, in view of the aforesaid circumstances, the petitioner may kindly be granted interim bail RENU RAWAT 2026.08.19 17.16 I attest to the accuracy and integrity of this document Chandigarh CRM-M-43430-2026 2 for a period of eight weeks to enable him to look after his wife and the newborn child. 3. In compliance with the order dated 07.08.2026, learned State counsel has produced the report in Court today, which is taken on record. The report states that the wife of the petitioner delivered a child on 07.08.2026. He has also filed the custody certificate of the petitioner, which is taken on record. As per the custody certificate, the petitioner has been in custody for the last 03 months and 27 days. 4. I have heard the submissions of ld. counsel for the parties and the perused the record. 5. Keeping in view the facts and circumstances of the case, and the fact that the wife of the petitioner has been blessed with a child on 07.08.2026, the petitioner is ordered to be released on interim bail for a period of six weeks, subject to his furnishing the requisite bail bonds and surety bonds to the satisfaction of the Illaqa Magistrate/Chief Judicial Magistrate/Duty Magistrate concerned. The period of interim bail shall commence from the date of his release. The learned trial Court is directed to ensure that the petitioner surrenders before the jail authorities upon completion of the period of interim bail.
