1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 117/2026 registered at Police Station Udaipur, District Surguja (C.G.), for the offence punishable under Sections 118(1), 296, 351(3) of BNS.

Case of the prosecution, in brief, is that on 10.07.2026 wife of the applicant lodged a written report to the effect that on 02.07.2026, at around 8:00 p.m., the present applicant assaulted his wife by means of an axe, resultantly, she sustained serious injuries over her legs and both hands. 2 the left hand and the injuries were reported to be serious in nature. On such complaint, the police registered the aforesaid offence against the present applicant.

Learned counsel for the applicant submits that the applicant is husband of the complainant. On account of some dispute and wear & tear, she made a false complaint. He submits that injuries sustained by victim are result of an accident. He further submits that applicant is in jail since 06.08.2026 and charge-sheet has already been filed. He would submit that there are two criminal antecedents, one was registered in the year 2023 under the Excise Act and another Istgasa was registered in the year 2026. He would pray for grant of bail.
4. On the other hand, learned counsel for the State would oppose the bail application. Ms. Ritika Verma, Panel Lawyer would submit that the present applicant seriously assaulted his wife, and resultantly, she sustained fracture injury to ankle of left leg and laceration over the left hand. She would further contend that the applicant has two criminal antecedents, and therefore, the application deserves to be rejected.
5. I have heard learned counsel appearing for the parties and perused the case diary.

Having considered the fact that there was some dispute between the husband and wife; the injured sustained fracture injury over ankle of left leg and lacerated wound over left hand; charge-sheet has already been filed, the applicant is in jail since 06.08.2026, one criminal antecedent was registered in the year 2023 under the Excise Act and another case was registered in the year 2026 and both are pending consideration; further, trial may take some
3 time for its conclusion, I am inclined to allow this application.

Accordingly, the regular bail application is allowed and it is directed that in the event of the applicant executing a personal bond for a sum of Rs. 50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
