JUSTICE S VISHWAJITH SHETTY - 3 - HC-KAR CNR: KAHC010520962026 NC: 2026:KHC:46805 CRL.P No. 11400 of 2026 ORAL ORDER Accused Nos.2 and 3 in Crime No.268 of 2026 registered by Yelahanka New Town, Police Station, Bengaluru City for the offence punishable under Section 143(2)(3) of BNS, 2023 and Section 3, 4, 5 of the Immoral Traffic (Prevention) Act, 1956, are before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.268 of 2026 was registered by Yelahanka New Town, Police Station, Bengaluru City for the aforesaid offences against Ravi and petitioners herein, based on the first information dated 20.06.2026 received from Raja G.C.P., Police Officer attached to Yelahanka New Town, Police Station. During the course of investigation of the said case, the petitioners herein were arrested on 20.06.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in - 4 - HC-KAR CNR: KAHC010520962026 NC: 2026:KHC:46805 CRL.P No. 11400 of 2026 Crl.Misc.No.6245 of 2026 was rejected on 13.07.2026. Therefore, they are before this Court. 4. A reading of first information dated 20.06.2026 would reveal that based on the credible information received on the said date at about 15 hours, to the effect that illegal activities of prostitution was being carried on in the premises of a spa known as 'International Blue Blossom Luxury Spa' within the jurisdiction of Yalahanka New Town Police Station, a raid was conducted to the said premises and petitioners herein, who were said to be working as managers in the said premises, were apprehended and 11 ladies were allegedly rescued from the said premises. Accused No.1 is said to be the owner of the said premises in which the alleged illegal activities were being carried on. Accused No.1 has been granted anticipatory bail by the jurisdictional Sessions Court in Crl.Misc.No.6917 of 2026 disposed of on 18.07.2026. The petitioners are said to be the managers working in the premises owned by accused No.1. - 5 - HC-KAR CNR: KAHC010520962026 NC: 2026:KHC:46805 CRL.P No. 11400 of 2026 5. It is not in dispute that the petitioners do not have any criminal antecedents. Considering the aforesaid aspects of the matter and also the punishment provided for the alleged offences, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R The Criminal Petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.268 of 2026 registered by Yelahanka New Town, Police Station, Bengaluru City for the offence punishable under Section 143(2)(3) of BNS, 2023 and Section 3, 4, 5 of the Immoral Traffic (Prevention) Act, 1956, subject to the following conditions: a) The petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties, out of which, one shall be - 6 - HC-KAR CNR: KAHC010520962026 NC: 2026:KHC:46805 CRL.P No. 11400 of 2026 local surety, for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
