Hon'ble Shri Bibhu Datta Guru , Judge Order on Board 24.09.2026 1. By way of the present writ petitions, the petitioners, who are teachers, have challenged the order dated 07.03.2020, whereby it has been held that the petitioners are not entitled to the benefit of two advance increments. Further, the petitioners are also challenging the recovery of the amount already paid towards the said advance increments. 2. Learned counsel for the petitioners submits that the issue involved in 6 the present writ petition is covered by the judgment passed by this Court in the matter of Dinesh Kumar Verma Vs. State of C.G. and Others, passed in WPS No. 2382 of 2020. He submits that, insofar as the issue relating to grant of two advance increments is concerned, this Court, in the aforesaid judgment, has held that the petitioners therein were not entitled to the benefit of two advance increments on acquiring B.Ed./D.Ed./B.T.I. certificates at their own expenses. The relevant portion of paragraph 14 of the said judgment is reproduced hereinbelow: “14. The issue with regard to the entitlement of two advance increments of the petitioners on acquiring B.Ed./D.Ed./B.T.I. certificates at their own expenses has already been settled in the matter of Neelam Dubey (Supra), therefore, in my opinion, no case is made out for interference.” 2. Learned counsel for the petitioners further submits that paragraph 16 of the aforesaid judgment deals with the recovery of the amount towards advance increments already paid to the petitioners, and the recovery therein has been quashed. 3. Learned State Counsel submits that, insofar as the issue relating to grant of two advance increments is concerned, the same has already been decided by this Court in Dinesh Kumar Verma (supra). However, insofar as the issue of recovery is concerned, the present petition is premature, as no order of recovery has been passed against the petitioners till date. She submits that the petitioners would be at liberty 7 to approach this Court, if so advised, as and when any order of recovery is passed against them. 4. I have heard learned counsel for the parties and perused the records. 5. In view of the submissions made by learned counsel for the parties, insofar as the claim for grant of two advance increments is concerned, the said issue already stands settled by the judgment passed by this Court in Dinesh Kumar Verma (supra), wherein the petitioners therein were held not entitled to the said benefit. Therefore, no interference is called for on the said issue. 6. Insofar as the issue of recovery is concerned, since admittedly no order of recovery has been passed against the petitioners till date, the petitioners are at liberty to approach this Court, if so advised, as and when any cause of action arises in that regard. 7.
