….for the de facto. 1. Memo of evidence filed in Court is taken on record. 2. Upon hearing the learned advocates for the petitioner, the de facto complainant and the State and on perusal of the materials in the case diary, it appears that the petitioner is the own brother of the de facto complainant. It has been submitted by the learned advocate for the petitioner that there are property disputes in between the brothers. 3. Learned advocate for the de facto complainant submits that there were previous incidents of assault in between the parties. The injuries were inflicted by the present petitioner. 2
4. I have gone through the case diary. There are allegations of assault against the present petitioner. The statement recorded under Section 180 of BNSS contained in the case diary, does not disclose the use of any weapon. Moreover, the injury report shows the nature of injuries inflicted upon the person of the de facto complainant as simple. Charge sheet is yet to be submitted. 5. In such circumstances, considering the nature of allegations as well as the material in the case diary, the prayer for anticipatory bail of the petitioner is allowed. 6.
Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the BNSS and on further condition that the petitioner shall meet the Investigating Officer once in a fortnight till the conclusion of investigation and on condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. 7. Accordingly, CRM (A) 2554 of 2026 is allowed. 3
