Learned advocate appearing for the petitioners submits that the petitioners have been accused of possessing 29.58 kgs of ganja and are in custody for about 7½ months.
Learned advocate for the State opposes the prayer for bail and submits that so far as the petitioner no.2 is concerned, there is an offence under the provisions of Indian Penal Code. Against both the petitioners, there are no cases which were earlier registered under the NDPS Act as submitted by the State.
Having considered the overall circumstances and the fact that the charge-sheet refers to 15 witnesses which will consume some time, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed.

Accordingly, the petitioners, namely, Uday Biswas and Rajat Kayal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Howrah. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Howrah without prior permission of the learned special court.
Thus, CRM(NDPS) 1769 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record.
