ORAL ORDER
1. Heard learned Advocate Mr. Rajesh O. Gidiya for the petitioner, learned AGP Mr. Sahil Trivedi for the respondent-State and learned Advocate Mr. Kuldeep D. Vaidya for the respondent No.2.
2. The grievance raised by the petitioner is as regards the petitioner not being granted the benefit of GPF, instead the petitioner being covered under the CPF scheme, more particularly the Bhavnagar Municipal Corporation having included other similarly situated employees under the GPF scheme and having granted all benefits to such similarly situated employees. 2.1 As against the same, learned Advocate Mr. Vaidya for the respondent No.2-Corporation would point out that in case of similarly situated persons, this Court had directed the Corporation to
C/SCA/13025/2026(GJHC240576742026) ORDER DATED: 21/09/2026 extend similar benefits and whereas vide Resolution No. 830 dated 30.01.2026, the Standing Committee and vide Resolution No. 154, the General Body, had passed resolution whereby the Bhavnagar Municipal Corporation has decided to extend benefit of GPF to all retired employees, who are eligible for the same. Learned Advocate Mr. Vaidya, under instructions, would submit that the petitioner would be entitled to be covered under the Resolutions, more particularly the petitioner would be paid benfits after including him in the GPF scheme. Learned Advocate Mr. Vaidya would submit that appropriate proposal for grant of benefit to the petitioner has already been forwarded to the State Government.
3. Having regard to the above, since the Corporation has decided to include the petitioner under the GPF scheme, to this Court nothing further is required to be done. Hence, the petition stands
disposed of with a direction that the State Government shall ensure that appropriate action is taken upon the proposal/recommendation forwarded by the respondent-Corporation qua the petitioner, within a period of ten weeks from the date of receipt of this order.
4. Needless to clarify that the petitioner would be at liberty to take appropriate steps in case of any difficulty.
