JUSTICE H.SHANTHI BHUSHAN - 8 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE H.SHANTHI BHUSHAN) The present appeals are filed impugning the judgment and order dated 30.07.2025 passed by the learned Single Judge in W.P.No.1156/2023 (LR) c/w W.P.No.25020/2022. 2. The parties shall be referred to as per their ranking before the learned Single Judge. 3. Brief facts of the case are, the petitioners in W.P.No.1156/2023 are the legal representatives of one Munishamappa @ Muniswamaiah, who was the owner of the lands bearing Sy.No.91 (new Sy.No.91/2) measuring 6 acres 20 guntas, Sy.No.161/9 measuring 6 guntas, Sy.No.161/10 measuring 5 guntas and Sy.No.159 measuring 4 acres 7 guntas, situated at Kodihalli Village, Madure Hobli, Doddaballapura Taluk. The said lands were acquired by the predecessors of Munishamappa under registered sale deeds in the year 1950. His brother - 9 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 Sanjeevaiah filed Form No.7 claiming occupancy rights on the ground that he was cultivating the lands as a tenant under Munishamappa. The Land Tribunal initially granted occupancy rights in his favour on 17.08.1976. The said order was set aside by this Court in W.P.No.10613/1976 and the matter was remanded for fresh consideration. Upon remand, the Land Tribunal again granted occupancy rights in favour of Sanjeevaiah on 21.10.1986. That order was once again challenged before this Court in W.P.No.2113/1997, which, by order dated 15.06.2005, set aside the order and remanded the matter to the Land Tribunal to issue notice to all concerned parties and conduct a fresh enquiry. After such remand, the Land Tribunal passed the impugned order dated 16.11.2022, again conferring occupancy rights in favour of Sanjeevaiah and his legal representatives. 4. W.P.No.25020/2022 is filed by Maryselina A., who claims to have purchased a portion of the land from - 10 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 Munipillappa, son of Munishamappa and his family members under a registered Sale Deed dated 15.02.2014, followed by a Rectification Deed dated 17.11.2014, and she has challenged the same order of the Land Tribunal. 5. The case of the petitioners is that Munishamappa was himself cultivating the lands and that there was no tenancy in favour of Sanjeevaiah. It is contended that Sanjeevaiah, being none other than the brother of Munishamappa, had no independent right as a tenant and that neither he nor his legal representatives produced any material to establish payment of gutta or rent or any other circumstance evidencing the relationship of landlord and tenant. 5.1. It is further contended that the Land Tribunal, despite the earlier orders of this Court directing a fresh enquiry, relied upon the depositions of the parties recorded prior to the remand order and thereby misdirected itself. The respondents, on the other hand, - 11 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 supported the order of the Land Tribunal. It was contended on behalf of Sanjeevaiah and his legal representatives that the deposition of Sanjeevaiah disclosed that he was cultivating the land as a tenant and that the deposition of Munishamappa himself contained an admission regarding the tenancy. It was also contended that there is no legal impediment for a brother to be a tenant under his brother, who is the landlord, and that the Land Tribunal, after considering the material on record, had rightly granted occupancy rights. The other contesting respondents adopted the said submissions, while the State produced the original records before the Court. 6. On consideration of the material on record, undisputedly Munishamappa @ Muniswamaiah had purchased the lands and that his name stood in the revenue records. The RTC extracts for the relevant period from 1969-70 show the names of both Munishamappa and Sanjeevaiah in the cultivators’ column. However, neither - 12 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 Sanjeevaiah nor his legal representatives produced any gutta receipt or other document to establish that Sanjeevaiah was cultivating the lands as a tenant under Munishamappa. No independent witness was examined to establish such tenancy. Though there is no impediment in law for a brother to cultivate the land as a tenant under his brother, the essential relationship of landlord and tenant had to be established by acceptable evidence. The Land Tribunal, despite the earlier remands made by this Court, relied upon the depositions recorded prior to the remand and failed to consider the absence of acceptable material establishing tenancy. In the circumstances, a further remand would not serve any useful purpose. The material on record does not establish that Sanjeevaiah was cultivating the lands as a tenant under Munishamappa, and therefore the grant of occupancy rights in his favour cannot be sustained. - 13 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 7. Accordingly, the learned Single Judge allowed both the Writ Petitions. The order dated 16.11.2022 passed by the Land Tribunal, Doddaballapura Taluk, in LRF No.1201/1974-75, insofar as it confers occupancy rights in respect of the lands in question, was set aside in both the writ petitions. Consequently, the application in Form No.7 filed by Sanjeevaiah is rejected. Aggrieved by the said order, the legal representative of said Sanjeevaiah, has preferred these appeals. 8. When the appeals were taken up for hearing with the consent of the learned counsel appearing for the parties, the petitioners and the respondents have filed a Joint Memo/Compromise Petition under Order III Rule 3 of the Code of Civil Procedure, 1908, stating that they have amicably resolved the dispute between them on the terms and conditions set out in the compromise petition. 9. The parties are present before the Court and are identified by their respective learned counsel. The - 14 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 terms of the compromise petition have been read over and explained to the parties by their counsels. The parties admit the execution of the compromise petition and state that they have entered into the compromise voluntarily, out of their own free will and consent, without any force, coercion or undue influence. 10. This Court has perused the compromise petition and the terms contained therein. The compromise arrived at between the parties appears to be just lawful and does not appear to be vitiated by any illegality. The parties having settled the dispute amicably, there is no impediment to the compromise being recorded. Accordingly, the compromise petition is taken on record and the same is accepted. The terms of the compromise shall form part of this order. 11. The said Joint Memo reads thus: “JOINT MEMO The Appellant and the Respondents jointly submit as follows: - 15 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 1. It is humbly submitted that the present Writ Appeals are directed against the Impugned judgment and order dated 30/07/2025 passed in W.P. No. 25020/2022 C/w W.P. No. 1156 of 2023 ("Impugned Judgement"), whereby the learned Single Judge of this Hon'ble Court set aside the Order dated 16/11/2022 passed by the Land Tribunal, Doddaballapura, in LRF No. 1201/1974-75 ("Grant Order") and rejected Form No. 7 filed by late Sri. Sanjeevaiah under the Karnataka Land Reforms Act, 1961 ("KLR Act"), whose legal heir is the present Appellant herein, thereby denying occupancy rights in respect of lands in (1) Sy. No. 91 (New 91/2) measuring 5 Acres 19 Guntas; (ii) Sy. No. 159 measuring 4 Acres 16 Guntas (including 9 Guntas A Kharab); (iii) Sy. No. 161/9 measuring 06 Guntas and (iv) Sy. No. 161/10 measuring 05 Guntas of Kodihalli Village, Madure Hobli, Doddaballapura Taluk, Bengaluru Rural District ("4 Properties"). 2. During the pendency of the instant proceedings, the elders and well-wishers have facilitated settlement deliberations and accordingly the parties to the above lis have come to a consensus and decided to resolve their dispute amicably as per the following terms: Terms of the settlement: 3. Smt. Mary Celina A (Respondent No.1 herein in W.A. No. 1389 of 2025 & Respondent No.11 in W.A No.1388 of 2025), the legal heirs of Late Sri. Munishamappa (Respondent Nos. 5 to 9 in W.A. No. 1389 of 2025 & Respondent No. 1 to 5 in W.A No.1388 of 2025) and the legal heirs of Late Sri. Puttaiah (Respondent Nos. 10 and 11 in W.A. No. - 16 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 1389 of 2025 & Respondent No.9 & 10 in W.A No. 1388 of 2025) jointly consent to allow the instant Writ Appeals confirming the Grant Order in favour of the Sri. Kemmpanna @ Kempaiah (the Appellant in both Writ Appeals herein) only to the limited extent of: a. An extent of land measuring 1 Acre 30 Guntas (in addition to 5 Guntas Kharab land) in Sy. No. 159, situated at Kodihalli Village, Madure Hobli, Doddaballapura Taluk, which is more fully delineated and identified as Block No. II in the Sketch annexed to this memo as Annexure A and more fully described herein below as "Schedule B Property". b. An extent of land measuring 13 Guntas in Sy. No. 91 (new No. 91/2) situated at Kodihalli Village, Madure Hobli, Doddaballapura Taluk, which is more fully delineated and identified as Block No. II in the Sketch annexed to this memo as Annexure B and more fully described hereinbelow as the "Schedule C Property". 4. In consideration of the consent and concessions agreed to by the concerned Respondents in terms of Clause 3 hereinabove, the following corresponding obligations are agreed to and undertaken by the Appellant: a. The Appellant hereby unequivocally and unconditionally relinquishes and gives up his challenge in the present Writ Appeals insofar as it relates to the remaining portions of all the other lands covered under the Grant Order, save and except the Schedule B Property and Schedule C - 17 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 Property in respect of which the Grant Order is agreed to be confirmed in his favour. b. The Appellant hereby undertakes to ensure that his cousin Sri. Maluraiah S/o Late Sri. Nanja Maluraiah conveys in favour of Smt. Mary Celina A (the Respondent No.1 herein in W.A. No. 1389 of 2025 & Respondent No.11 in W.A No. 1388 of 2025) the land measuring 6 guntas in Sy. No. 90/6, situated at Kodihalli Village, Madure Hobli, Doddaballapura Taluk which is more fully delineated and identified as Block No. II in the Sketch annexed to this memo as Annexure C and more fully described hereinbelow as "Schedule D Property". The Affidavit of undertaking of Sri. Maluraiah is annexed herewith as Annexure D and may be read as part and parcel of the terms of this Settlement. Smt. Mary Celina A (the Respondent No.1 herein in W.A. No. 1389 of 2025) and Sri. Maluraiah S/o Late Sri. Nanja Maluraiah shall complete the registration of the Sale Deed within a period of one month from the date of receipt of the order passed by this Hon'ble Court in terms of this Joint Memo. 5. Accordingly, the Appellant has no objection to the absolute right, title and interest of the concerned Respondents in respect of: (i) the remaining extent of land in Sy. No. 91/2 (old Sy. No. 91), after excluding the Schedule C Property measuring 13 Guntas; (ii) Sy. No. 161/9 measuring 6 Guntas; (iii) Sy. No. 161/10 measuring 5 Guntas; and (iv) the Schedule A Property measuring 2 Acres 17 Guntas, together with 4 Guntas of Kharab land, in Sy. No. 159. - 18 - HC-KAR CNR: KAHC010550062025 NC: 2026:KHC:44665-DB WA No. 1389 of 2025 C/W WA No. 1388 of 2025 6. Furthermore, neither the Appellant nor the Respondents shall interfere with each other's peaceful possession or raise any future demands, claims, or legal proceedings regarding these properties. SCHEDULE 'A' PROPERTY (Block No. I as per annexed sketch at Annexure A) All that piece and parcel of land bearing Sy. No. 159, measuring 2 Acres 17 Guntas in addition to 4 Guntas of Kharab land, situated at Kodihalli Village, Madure Hobli, Doddaballapura Taluk, bounded on the: East by :Munisiddaiah's land in Sy.No.160/8; West by : Road; North by: land in Sy. No. 160/6; and South by: the remaining land in Sy. No. 159 of Sri. Kempanna @ Kempaiah & Munimallaiah's land. SCHEDULE 'B' PROPERTY (Block No. II as per annexed sketch at Annexure A) All that piece and parcel of land bearing Sy. No. 159, measuring 1 Acre 30 Guntas in addition to 5 Guntas of Kharab land, situated at Kodihalli Village, Madure Hobli, Doddaballapura Taluk, bounded on the: East by : Gangamma's land in Sy.No.160/9; West by : Road; North by: the remaining land in Sy. No. 159 of Smt. Mary Celina A; and South by: Munimallaiah's land. No. 90/6, measuring 6 Guntas, carved out of the larger extent of land in 15 Guntas, situated at Kodihalli Village, Madhure Hobli, Doddaballapura Taluk, Bengaluru Rural District, identified as Block No. II as per sketch annexed at Annexure C bounded on the: East by : Land in Sy. No. 91; West by : Remaining land in Sy. No. 90/6; North by: Land in Sy. No.90/1 belonging to Sri. Ashwath Narayana; and South by: Land in Sy. No. 90/21 belonging to Sri. Thammanna Gowda.” 12. In view of the compromise entered into between the parties, the proceedings are disposed of, in terms of the compromise petition.
