Accused No.2 in Crime No.92/2026 registered by Chelur Police Station, Chikkaballapura, for the offences punishable under Section 3(5) of BNS, 2023 and Sections 7, 25(1) and 25(B) of Arms Act, 1959, is before this Court in this petition filed under Section 482 of BNS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.92/2026 registered by Chelur Police Station, Chikkaballapura, for the aforesaid offences against one Nagesha and petitioner herein based on the first information dated 07.07.2026 received from Manjunath, police officer attached to Chelur Police Station. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.370/2026 before the jurisdictional Sessions Court, which was rejected on 23.07.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that based on credible information received, a raid was conducted to the house of accused No.1 at about 05.30 p.m. on 07.07.2026 - 3 - HC-KAR CNR: KAHC010522672026 NC: 2026:KHC:47014 CRL.P No. 11405 of 2026 and from his house, unlicensed gun was recovered. Accused No.1, who was present in the house, during the course of enquiry, allegedly informed the police that the said gun was given to him by accused No.2. It is under these circumstances, FIR was registered against accused Nos.1 and 2 for the aforesaid offences. Police, who had raided the house of accused No.1 and had seized an unlicensed gun from his house in his presence had not arrested him. Subsequently, accused No.1 has been granted anticipatory bail in the present case by the jurisdictional Sessions Court. So far as the petitioner is concerned, except the confession statement of the accused No.1, there is absolutely nothing on record. He has undertaken to cooperate with the police for the purpose of investigation. It is not in dispute that he has no other criminal antecedents. Accordingly, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.92/2026 registered by Chelur Police Station, Chikkaballapura, for the offences punishable under Section 3(5) of BNS, 2023 and - 4 - HC-KAR CNR: KAHC010522672026 NC: 2026:KHC:47014 CRL.P No. 11405 of 2026 Sections 7, 25(1) and 25(B) of Arms Act, 1959, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
