Learned advocate for the petitioner submits that the petitioner has been implicated in this case only on the basis of statement of a co-accused where recovery was 248 bottles of phensedyl. Charge-sheet has also been submitted, as such, the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that the recovery was from the house of the present petitioner who was evading the process of law for a period of two years and has been arrested very recently. However, on a query from this court, learned advocate submits that there are no materials to suggest that
2 there is any previous antecedent so far as the present petitioner is concerned. Having considered that date has been fixed for consideration of charges and some time will be required to take the trial to its logical conclusion as also the fact that the petitioner has no antecedent, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Sujit Mandal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), 4th Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1779 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
