CRM-M-28444-2026 - 1 - IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 127 CRM-M-28444-2026 Decided on : 12.08.2026 Gurpratap Singh . . . Petitioner(s) Versus State of Punjab and others . . . Respondent(s)
CORAM: HON'BLE MR. JUSTICE SANJAY VASHISTH PRESENT: Mr. Anupam Bhardwaj, Advocate for the petitioner(s). Mr. Manjinder S. Bhullar, DAG, Punjab. **** SANJAY VASHISTH, J. (Oral)
1. Present petition has been filed under Section 528 of BNSS, 2023, seeking issuance of directions to respondents No.1 to 4 for taking appropriate legal action against respondent No.5, who was declared a ‘proclaimed person’ vide order dated 29.04.2023 (P-2), passed by learned JMIC, Amritsar, in proceedings of NACT/253/2019, dated 10.01.2019.
2.
Learned counsel for the petitioner relies upon order dated 10.10.2023 (P-3), passed in CRM-M-51406-2023 (Manjit Singh v. Gurpartap Singh and another) and submits that, despite the said order granting liberty to Manjit Singh (respondent No.5 herein) to surrender before the Court concerned within a period of fifteen days, respondent No.5 has not appeared before the trial Court till date.
3.
Learned counsel further submits that after declaring respondent No.5 as a ‘proclaimed person’, even FIR under Section 174-A of IPC (Section 203 of BNS, 2023) has also been registered. Still, respondent No.5 JAWALA RAM 2026.08.17 13:22 I attest to the accuracy and integrity of this document
CRM-M-28444-2026 - 2 - is not coming forward, nor is the Investigating Agency taking any effective step towards execution of the order passed by the trial Court.
4. After hearing learned counsel for the petitioner and perusing the material available on record, this Court is of the view that merely on account of non-compliance/non-execution of the order passed by the trial Court, and that too without first approaching the said Court, such a petition, literally seeking execution of the Magistrate's order, is not maintainable before this Court.
5. In view of the above, present petition is found to be misconceived and not maintainable before this Court. Accordingly, same stands dismissed. Pending misc. application(s), if any, also stand(s) disposed of.
