The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Section 309(4) of BNS in connection with Katkamdag PS Case No. 148 of 2025. 3. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He submits that a mobile phone and a sum of Rs. 9,500/- have allegedly been seized from the possession of the petitioner and such a seizure cannot be termed incriminating or be made the basis to implicate the petitioner in the alleged offence. He further submits admittedly no Test Identification Parade of the petitioner has ever been conducted and name of the petitioner has transpired on the basis of confessional statement of co-accused. Learned counsel lastly submits that the petitioner is in custody since 16.09.2025 as such, he may be enlarged on bail. 4. Learned APP opposes the prayer for bail of the petitioner. 5. Having regard to the allegation made against the petitioner coupled with the fact that the petitioner is in judicial custody since 16.09.2025, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with 2026:JHHC:6987 2 two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Hazaribag in connection with Katkamdag PS Case No. 148 of 2025. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner. 7.
