Mr. Bapin Baidya ….for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendant nos.16, 17 and 18 praying for a direction upon the learned Civil Judge (Sr. Div.), 2nd Court at Baruipur, District-South 24-Parganas to dispose of the petition praying for recalling of the order dated June 24, 2025 expeditiously. From the order sheets appended to this application, this Court finds that July 14, 2026 was fixed for hearing of such application. The learned advocate appearing for the petitioner submits that September 8, 2026 is the next date fixed for hearing of such recalling application In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 1545 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 2 2nd Court at Baruipur, District-South 24-Parganas to take up the hearing of the application for recalling of the order dated June 24, 2025 on the next date fixed, i.e. on September 8, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
