Accused nos.1 & 2 in Crime No.213/2026 registered by Sampigehalli Police Station, Bengaluru City, for the offences punishable under Sections 80, 85 read with 3(5) of BNS, 2023, and Sections 3 & 4 of Dowry Prohibition Act, 1961, are before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. Learned Counsel for petitioners submits that this petition in so far as it relates to accused no.1/petitioner no.1 may be dismissed as not pressed with liberty to accused no.1 to file a fresh bail application after the charge sheet is filed. 4. The aforesaid submission is placed on record. Petition is dismissed as not pressed in so far as it relates to accused no.1, with liberty as prayed for. - 3 - HC-KAR CNR: KAHC010519882026 NC: 2026:KHC:46376 CRL.P No. 11410 of 2026 5. FIR in Crime No.213/2026 was registered Sampigehalli Police Station, Bengaluru City, for the aforesaid offences against Imran Khan and two others based on the first information dated 18.06.2026 received from Asif Ahmmed - father of deceased Umera Ilaf. During the course of investigation, accused nos.1 & 2 were arrested on 25.06.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.6789/2026 was rejected on 14.07.2026. Therefore, petitioner is before this Court. 6. Material on record would go to show that accused no.1 is the husband of the deceased and accused no.2 is her mother- in-law. Marriage of the deceased with accused no.1 was a love marriage which was performed by the parents of both the parties on 20.12.2024. It is alleged that subsequent to the marriage there was demand for dowry and deceased was being harassed in her matrimonial house. It is also alleged that accused no.1 had come to the house of the first informant on the night of 16.06.2026 and had informed her that conduct of the deceased was not good and he intends to marry some other - 4 - HC-KAR CNR: KAHC010519882026 NC: 2026:KHC:46376 CRL.P No. 11410 of 2026 girl. On 17.06.2026, accused no.2 had called the first informant over phone and had asked him to speak to his daughter who was crying. Subsequently, the wife of accused no.1 had committed suicide by hanging herself. 7. A reading of the first information would go to show that the allegations made in the first information are against accused no.1 and as against accused no.2 there are omnibus allegations. Accused no.3 is the sister of accused no.1. Considering the nature of allegations against accused no.2, who is a lady aged about 50 years, I am of the opinion that accused no.2/petitioner no.2's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 8. Petition is allowed in part. Accused no.2/petitioner no.2 is directed to be enlarged on bail in Crime No.213/2026 registered by Sampigehalli Police Station, Bengaluru City, for the offences punishable under Sections 80, 85 read with 3(5) of BNS, 2023, and Sections 3 & 4 of Dowry Prohibition Act, 1961, subject to the following conditions: a) Accused no.2/petitioner no.2 shall execute personal bond for a sum of Rs.1,00,000/- with two - 5 - HC-KAR CNR: KAHC010519882026 NC: 2026:KHC:46376 CRL.P No. 11410 of 2026 sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Accused no.2/petitioner no.2 shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons; c) Accused no.2/petitioner no.2 shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Accused no.2/petitioner no.2 shall not involve in similar offences in future.
