Respondent no.13 remains unrepresented before this Court. Learned counsel appearing on behalf of the petitioner submits that the Executive Officer, Kalyani Panchayat Samiti, issued a lease in favour of the petitioner for the operation and maintenance of Char Jatra Siddhi Ferry Ghat within Kalyani Gram Panchayat for a period of two years commencing from July 26, 2025. Pursuant thereto, the petitioner has been operating and maintenance the said ferry ghat. It is further alleged that the respondent no.13, without any authorization from the competent authority, has also been conducting ferry operations from Char Jatra Siddhi Ferry Ghat, Nadia to 2 Laxmibazar, Hooghly. According to the petitioner, such unauthorized operation has adversely affected his business. The petitioner contends that, despite submitting a representation before the Executive Officer, Kalyani Panchayat Samiti, complaining against respondent no.13, no steps have been taken to prevent the alleged illegal ferry operations. In the aforesaid circumstances, this writ petition is disposed of with a direction upon the Executive Officer, Kalyani Panchayat Samiti, to consider the representation of the petitioner received on December 3, 2025, within a period of one month from the date of communication of this order. The said Executive Officer shall afford an opportunity of hearing to the petitioner as well as respondent no.13 and shall pass a reasoned order within the aforesaid period. Accordingly, WPA 3372 of 2026 stands disposed of. There shall be no order as to costs. Urgent Photostat copy of this order, if applied for, be supplied to the parties on an urgent basis.
