Rakshit … for the defacto-complainant (H.C.L.S.A.) Learned advocate for the petitioner submits that the petitioner is in custody for more than ten months and charge-sheet has already been submitted but there is no possibility of the witness action commencing very soon. Learned advocate for the defacto-complainant is present and opposes the prayer for bail. Learned advocate also submits that the age of the victim is five years. Learned advocate for the State produces the case diary and draws the attention of the court to the statement of the victim. I have taken into account the statement of the victim as well as the medico-legal examination report. 2 Having regard to the overall circumstances, I am of the opinion that this is not a fit case for granting bail to the petitioner. Hence, the prayer for bail of the petitioner is Rejected. However, the petitioner will renew his prayer for bail after the evidence of the victim is over. Accordingly, CRM (M) 1474 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
