1. During the course of hearing, the de facto complainant submits that, following a misunderstanding between the petitioner and the de facto complainant, both of whom are practicing Advocates of this Court, the present case came to be registered. He submits that he intended to issue a notice of defamation; however, the concerned Investigating Officer treated the said notice as a complaint and initiated the present criminal case on the basis thereof. He submits that the matter has since been settled. He further submits that, without conducting any preliminary inquiry, the present case was initiated. He submits that, if the petitioner is granted the privilege under Section 482 of the BNSS, he has no objection thereto.
2. Learned Advocate appearing for the State, produces the case diary and leaves the matter to the discretion of the Court.
3. In view of the stand taken on behalf of the de facto complainant and considering the facts and circumstances of the case, I am of the view
2 that it would be apposite to extend the benefit under Section 482 of the BNSS in favour of the petitioner.
4. In view of the above, the prayer for anticipatory bail is allowed.
5. Accordingly, I direct that, in the event of arrest, the petitioner, viz. Arunangshu Chakraborty be released on bail upon furnishing a bond of Rs. 5,000/-, with two sureties of like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bidhannagar and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023
6. The application for anticipatory bail is, thus, disposed of.
