Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year and till date witness action has not commenced although charges were framed on 19.01.2026. Additionally, it has been submitted that the petitioner was a driver who had no knowledge regarding the goods which were being carried and was temporarily on service. Learned advocate for the State opposes the prayer for bail and submits that 360.5 kgs of Acetic Anhydride were recovered along with Calcium Hydroxide. So far as the Calcium Hydroxide is concerned, the test is negative. I have considered the materials which have been collected and seized. Prima facie, such huge materials could not 2 have been without the knowledge of the present petitioner. Another accused is absconding. However, the prosecution cannot claim that the accused be detained for indefinite period. As such, prosecution is directed to take steps so that the evidence commences from the next date. So far as the bail of the petitioner at this stage is refused as the rigors of Section 37 of the NDPS is attracted. Accordingly, CRM(NDPS)1734 of 2026 is dismissed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
