D/L31 19.08.2026 Bpg. Allowed C.R.M. (M) 986 of 2026 In Re: An application for Bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Mogra Police Station Case No.320 of 2025 dated 09.07.2025 under Sections 316(2)/318(4)/351(2)/3(5) of the Bharatiya Nyaya Sanhita adding Sections 111(2)(b)/111(3) of the Bharatiya Nyaya Sanhita; Ujjal Roy Versus The State of West Bengal Mr. Bitasok Banerjee Ms. Debangana Bhattacharya. ...for the petitioner. Mr. Sagar Saha Ms. Nayana Mukhopadhyay. …for the State. Learned advocate appearing for the petitioner submits that the other accused, the directors of the company have been granted bail. Petitioner was an agent who has been shown to be the co-founder and is detained in custody. Learned advocate for the State submits that earlier rejection reflects direction was passed for renewal of prayer after the charges are framed. Till date all the accused persons are not before the court, processes have been issued and execution is being attempted by the police authorities. Be that as it may, as the other accused persons are on 2 bail and the petitioner is not much differently located than the other accused persons, I am inclined to extend the same benefit. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Ujjal Roy shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Hooghly. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Hooghly without prior permission of the learned trial court. Thus, CRM(M)986 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record.
