3. Present bail application is moved by the applicant, who is in judicial custody in connection with FIR No.98 of 2026 for the offences punishable under Section 8/21 of Narcotic Drugs and Psychotropic Substances Act, Police Station Kichha, District Udham Singh Nagar.

Learned counsel for the applicant submits that applicant has been falsely implicated in the instant crime; there was no independent witness. It is stated that applicant has been made a scapegoat in the present case and he has been languishing in jail since 19.03.2026. She further submitted that 122.25 grams of charas has been recovered from the possession of the applicant, which is a non- commercial quantity.
5. Learned State counsel opposed the bail application.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is of the view that applicant is entitled to the released on bail.
7. Accordingly, bail application is allowed. Let the applicant-Santokh Singh be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of court concerned.
