1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. Supplementary affidavit filed on behalf of the petitioner is also taken on record. 3. By the present writ petition, the petitioner seeks direction upon the respondent authorities to grant inter-District transfer to the petitioner from her present place of posting in the District of Dakshin Dinajpur to a school in the District of Malda on distance ground. 4. The petitioner contends that she joined as an Assistant Teacher in Gobindapur Pry./Jr. Basic School, under Gazole North Circle, District Malda on 15th February,
2017. The petitioner’s service has been confirmed with effect from 15th February, 2019. Subsequently, the petitioner has been transferred to Kalikapur Mission F.P.
2 School, where she joined on 14th October, 2020. The petitioner’s residence is situated about 106 kilometers away from her present place of posting. On 12th November, 2025 the petitioner made a representation before the authority concerned for her transfer. However, the said representation is still pending consideration. Hence, this writ petition. 5. Mr. Kingsuk Mondal, learned Advocate appearing on behalf of the petitioner seeks liberty to file fresh representation before the concerned authority seeking for transfer on distance ground since the earlier representation was made on medical ground. 6. Learned Advocates for the Board and State as well as respective District Primary School Councils submit that the Utsashree portal is presently functional and the petitioner should file such application seeking transfer through Utsashree portal under the existing rules. 7. To this, Mr. Mondal, learned advocate appearing for the petitioner submits that the Utsashree portal is not functional as yet. 8. In view of the above, liberty is granted to the petitioner to file application through Utsashree portal seeking transfer on distance ground.
In the event, the petitioner is unable to submit such application through Utsashree portal, she is permitted to file comprehensive representation before the authority concerned seeking transfer on distance ground and the respondent no.4, the Secretary, West Bengal Board of Primary Education shall consider the comprehensive representation of the petitioner and
3 dispose of the same, upon giving notice to the petitioner, by passing a reasoned order in accordance with law, within a period of eight weeks from the date of submission of such representation. 9. The reasoned order is to be communicated to the petitioner within one week from the date of passing of such order. 10. Learned advocate for the petitioner is directed to communicate this order to the respondent no.2, the Secretary, West Bengal Board of Primary Education. 11. With the above direction, the writ petition being WPA 26976 of 2025 stands disposed of. 12. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 13. Interim order, if any, stands vacated. 14. All connected applications, if any, stand disposed of. 15. There shall be no order as to costs. 16. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 17. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
