1. This is fourth bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 135/2025 registered at Police Station Pali, District Korba (CG) for the offences u/s 137(2), 64, 64(2)(m), 65(1)of BNS and Sections 4 & 6 of the Protection of Children from Sexual Offences Act, 2012.
2. The 1st and 2nd bail applications have been rejected on merits and the third bail application has been withdrawn.
3. As per the prosecution case in short, is that a report has been lodged by the maternal uncle of the prosecutrix to the effect that his minor niece went somewhere from the house at 1:00 PM without informing anyone and on searching for her in the vicinity, she could not be found. An unknown
2 person has kidnapped her by luring her. On 13.04.2025, the victim came to the Police Station and when her statement was recorded, she told that the accused allured and called her to the courtyard of his house on 28.02.2025 and forcibly had established physical relations with her on the pretext of marriage. Thereafter again on 08.03.2025 he had physical relations with her saying that he loves her and wants to marry her. On 12.4.2025, he forcibly took her away to his house and kept her hidden. Based on above, offence has been registered against the applicant.

Learned counsel for the applicant submits that the document obtained under RTI Act (Annexure A-6) shows that at the time and date of incident the applicant was working as driver in SECL and he was not present on the spot, therefore, he has been falsely implicated in this case. He submits that the applicant is in jail since 14.04.2025; till date out of 23 witnesses, 13 have been examined and the trial is likely to take time, therefore, looking to these aspects, the applicant may be enlarged on bail at this stage.
5. Per contra, learned State Counsel opposes the bail application and submits that at the time of incident, the victim was minor.
6. The Victims along with her mother have appeared through VC from the concerned DLSA and objected to grant bail.
7. The key witnesses – victim, her mother and uncle had already been examined in the year 2025. The defense has not been able to confront the witnesses with the RTI document (obtained on 24.08.2026) because it has been acquired at a belated stage. Therefore, there are no changing circumstances in the case to warrant bail.
8. Having thus considered the submissions made by learned counsel for the parties and the court statements of the victim, her mother and uncle and looking to the fact that there is no changing circumstances in this
3 case, I am not inclined to allow this bail application. Accordingly, this fourth bail application is dismissed.
9. However, looking to the long custody of the applicant as he is stated to be in jail since 14.04.2025, the trial Court is directed to expedite the trial as early as possible preferably within a period of 4 months from the date of receipt of copy of this order.
