The petitioner – wife of the detenu – Siddharth Asar (CTP No.16171) is before this Court seeking for the following reliefs: a) Issue a writ of mandamus or any other appropriate writ, order or direction, directing the Respondents to consider and grant Emergency Parole to the Petitioner's Husband, Sri Siddharth Asar (CTP No: 16171), in accordance with the provisions of the Karnataka Prisons Rules; b) Pass an order or direction in the nature of a writ of mandamus directing Respondent No. 2 to release the Petitioner's husband, Sri Siddharth Asar (CTP No: 16171), on Emergency Parole; c) Also grant any additional order/direction that this Hon'ble court may deem fit to grant under the facts and circumstances in the interest of justice and Equity. - 3 - HC-KAR CNR: KAHC010518742026 NC: 2026:KHC:44867 WP No. 23637 of 2026 2. The detenu had been convicted in C.C.No.21824/2021, C.C.No.21828/2021 and C.C.No.21832/2021 for offence under Section 138 of N.I.Act by XXI ACMM, Bengaluru and sentenced on 11.05.2026. 3. The detenu had been convicted and sentenced in three cheque bounce matters. All three of them put together being in excess of Rs.5,00,00,000/-. In each of them being sentenced to serve one year simple imprisonment. The detenu has served only 2 months 10 days of the sentence as on 20.07.2026 and there are other pending cases of cheque bounce against the detenu. 4. In that view of the matter, this Court is not inclined to grant parole to the detenu who has served only 2 months 10 days.
