HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Crl A(D) No. 17/2025 Fayaz Ahmed Bhat .....Applicant(s)/Petitioner(s) Through :- Ms. Shamima Jan, Advocate v/s UT of J&K and Another .....Respondent(s) Through :- Ms. Monika Kohli, Sr. AAG with Ms. Priyanka Bhat, Advocate CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE MA CHOWDHARY, JUDGE ORDER 09.10.2026 Having argued for some time, learned counsel for the appellant seeks leave of this Court to withdraw this appeal with liberty to file fresh bail application after some more material witnesses are recorded. It is submitted that at the time when this appeal was filed, only nine witnesses had been examined, but during the pendency of this appeal, 11 more witnesses have been examined. Be that as it may, in view of the request made, this appeal is permitted to be withdrawn. This appeal is, accordingly, dismissed as withdrawn with liberty as prayed for. Needless to say that in case a fresh bail application is presented before the trial Court, the same shall be considered purely on its own merits and in the light of evidence recorded without the trial Court being prejudiced by the observations made in the order impugned.
