Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in nonpayment of amounts due for the last three years even after finalizing the hills, payable to the petitioner after the successful completion of the execution of work i.e., Neeru Chettu OandM work such as removal of weed growth in canals in WUA No.206, Salempalem for Kariff for the year 2018 - 2019 under Neeru-Chettu programme duly approved by the respondents, as illegal, arbitrary,- unjust, unreasonable and unconstitutional and consequently direct the respondents to consider the payment of amounts due to the petitioner in respect of execution of said works forthwith and to pass IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to pay the amounts payable to the petitioner for the work i.e., "Neeru Chettu OandM work such as removal of weed growth in canals in WUA No.206, Salempalem for Kariff for the year 2018 2019" executed by him under "Neeru-Chettu" programme immediately, pending disposal of the main writ petition and pass IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to extend the time limit for implementation of the interim orders dated 02.03.2022 passed in I.A. The above writ petition was filed to declare the action of the respondents in not paying the amounts in relation to the work executed by the petitioner, as illegal and arbitrary. 2. Today, when the matter is taken up for consideration, Sri Sk. Jahangir Pasha, learned counsel representing Smt. Nimmagadda Revathi, learned counsel for the petitioner and the learned Assistant Government Pleader for Irrigation submitted that pending the writ petition, amount has been paid to the petitioner and hence, nothing survives for adjudication, in this writ petition. 3. Given, the submission of learned counsel on either side since amount has been paid to the petitioner, no further orders are required in this writ petition. 4. Accordingly, this Writ Petition is dismissed as infructuous. No order as to costs.
