By way of the instant writ petition, the petitioner, who is a retired government servant, is seeking a direction towards the respondent authorities to reimburse an amount of Rs.53,588/- under the Chhattisgarh Civil Services (Medical Attendance) Rules, 2013 (hereinafter referred to ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2026.09.23 10:41:34 +0530 2 / 3 as the Rules, 2013) for the operation of Cataract undergone by the Petitioner by Ashirvad Laser and Eye Hospital, Bilaspur. 2. Learned counsel for the petitioner would submit that the petitioner, who has retired from government service, underwent cataract surgery at Ashirwad Laser and Eye Hospital, Bilaspur, which is a recognized hospital under the State Government. The grievance of the petitioner is that despite the treatment having been duly certified for reimbursement, the admissible amount has not been reimbursed to him. By referring to Annexure P/2, learned counsel submits that respondent No.5, namely, the Civil Surgeon-cum-Chief Medical Superintendent, District Sakti, vide certificate dated 17.03.2026, has certified the petitioner's entitlement to reimbursement of an amount of ₹53,588/- under the provisions of the Chhattisgarh Civil Services (Medical Attendance) Rules, 2013, in respect of the cataract operation undergone by the petitioner at the aforesaid hospital and despite the aforesaid certificate issued by respondent No.5, the amount has not been reimbursed to the petitioner. It is submitted that the petitioner thereafter approached the concerned authority by submitting a representation dated 23.03.2026 seeking reimbursement of the said amount, but no decision was taken on his representation. Learned counsel, therefore, submits that the petitioner would be satisfied if the District Education Officer, Sakti, is directed to consider and decide the petitioner's claim for reimbursement in accordance with the Chhattisgarh Civil Services (Medical Attendance) Rules, 2013, particularly in view of the certificate issued by respondent No.5 dated 17.03.2026, within a stipulated period. 3 / 3 3. Learned State Counsel, on instructions, submits that the Block Education Officer has already forwarded a communication to the District Education Officer on 21.06.2026 for processing the claim of the petitioner. He further submits that the claim of the petitioner for reimbursement shall be considered by the District Education Officer in accordance with the applicable Rules within a reasonable time. 4. I have heard learned counsel for the parties and perused the documents. 5. In view of the submissions made by learned counsel for the parties and without expressing any opinion on the merits of the claim, the petition is disposed of with a direction to the District Education Officer, Sakti, to consider the case of the petitioner regarding reimbursement of the amount incurred towards medical treatment, in accordance with the Chhattisgarh Civil Services (Medical Attendance) Rules, 2013, on the basis of the certificate issued by respondent No.5 dated 17.03.2026, and take an appropriate decision thereon within a period of 35 days from the date of receipt of a copy of this order. 6. The petitioner shall apprise the District Education Officer of this order and furnish a copy thereof along with the relevant documents for necessary consideration. 7.
