Applicant has filed this First Bail application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 428/2026 registered at Police Station – Utai, District- Durg, (C.G.) for offence punishable under Section 4, 6, 10 of Chhattisgarh Agricultural Cattle Preservation Act, 2004 and Section 11 of the Prevention of Cruelty to Animals Act, 1960.
2. Case of prosecution in brief is that, on 19.08.2026 Assistant Sub- Inspector Madan Lal Sahu purportedly received an information that near Pauwara Purai Road Nursery, Purai near a sand mound, seven to eight ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2026.09.23 15:19:21 +0530
2 persons have parked a white Mahindra Bolero Pick Up bearing registration no. CG 04 PF 6904 and were loading cattle (buffaloes) in the vehicle for transporting them to slaughter house. Based upon the aforesaid information Police reached on spot and apprehended some persons. Applicant was the owner of the vehicle in which buffaloes were being loaded, however, when applicant saw the Police, he ran away. Other co-accused persons were arrested at the spot.

Learned counsel for applicant submits that applicant has been falsely implicated in the crime, he has not committed any offence as alleged. He further submits that applicant has been made accused on the basis of the memorandum statement of other co-accused and also on the basis that the vehicle in which Police found three buffaloes that were being loaded, belongs to the applicant. Applicant will co-operate with the investigation and there is no likelihood of his absconding. Hence he may be enlarged on bail.

Learned counsel for State opposes the submission made by learned counsel for the applicant and submits that according to the material available in the case diary, it is appearing that applicant himself was driving the alleged vehicle and after seeing the Police has ran away from the spot. He submits that applicant has one criminal antecedent registered against him for the commission of alleged offence under Section 294, 506 and 323 of Indian Penal Code bearing Crime No. 81 of 2018 registered at Police Station Purani Gandai, District Rajnandgaon, C.G.
5. I have heard learned counsel for the parties and perused the documents enclosed along with the bail application.

Taking into consideration the facts and circumstances of the case, nature of allegations, submission made by learned counsel for the respective parties and also considering the penalty provided under Section 10 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004 as also the fact that no similar offence is registered against the applicant, without commenting anything on the merits of the case, I am inclined to allow this application for grant of bail.

Accordingly, application is allowed and it is directed that in the event of arrest of applicant in connection with the aforesaid crime, she shall be released on anticipatory bail by the Officer arresting her on executing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned arresting officer. Applicant shall also abide by the following conditions :-
“(i) that the applicant shall remain available for interrogation before the Investigating Officer as and when required; (ii) the applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such
