Learned advocate for the petitioners submits that inspite of the earlier directions, till date, two of the independent witnesses have not been examined: one of the independent witnesses was examined and he has been declared hostile. Learned advocate for the State opposes the prayer for bail. I have taken into account the period of detention of the present petitioners which is for 11 months. Having considered the present stage of the case, I direct that the second independent witness (CSW 9), who has been summoned, be completed.
2 If the trial court finds that both the independent witnesses are not supporting the prosecution’s case, in that case, if any application for bail is preferred by the petitioners, the learned trial court would consider the same leniently in accordance with law. At this stage, I am not inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Rejected. With the aforesaid observations, CRM (NDPS) 1763 of 2026 is disposed of. Pending application(s), if any, is also disposed of. The learned trial court would adhere to the directions passed above. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
