Accused No.2 in Crime No.121 of 2026 registered by Hallymysore Police Station, Hassan District for offences punishable under Sections 8(C), 20(b), 20(b)(ii)(B) of NDPS Act, 1985 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. FIR in Crime No.121 of 2026 was registered by Hallymysore Police Station, Hassan District for the aforesaid offences against Jabiullah and the petitioner herein, based on the first information dated 12.07.2026 received from Smt. Navya L, police officer attached to Hallimysore police station. During the course of investigation of the said case, petitioner was arrested and remanded to judicial custody on 13.07.2026. Her bail application filed before the jurisdictional Sessions Court was rejected on 27.07.2026. Therefore, she is before this Court. 3. Perusal of the material on record would go to show that, based on the credible information on 12.07.2026 a raid was conducted by the first informant and his staff to a place - 3 - HC-KAR CNR: KAHC010552992026 NC: 2026:KHC:45086 CRL.P No. 12272 of 2026 near SPG bar and restaurant, Hassan-Mysore Highway within the jurisdiction of Hallimysore Police Station, where two persons, standing near a car and a scooter were allegedly moving in a suspicious manner. The police on arrival noticed a male and female standing near a car bearing registration No.KA-11-M-8783 and a scooter bearing registration No.KA-04- LC-7204. After seeing the police, the male, who was present there managed to escape while the female present there was apprehended by the police. On enquiry, she had revealed her name as 'Sheela' and also mentioned that, the person, who escaped was Jabiullah (Accused no.1). The car present there belonged to accused no.1, while the scooter belonged to Sheela (Accused no.2). The police thereafter, recovered 920 grams of contraband article allegedly Ganja from the scooter belonging to accused no.2 and contraband article allegedly Ganja weighing 6 kg 50 grams from the car belonging to accused no.1. Accused no.2 was thereafter, arrested and FIR was registered against accused nos.1 and 2 in Crime No.121 of 2026. - 4 - HC-KAR CNR: KAHC010552992026 NC: 2026:KHC:45086 CRL.P No. 12272 of 2026 4. Undisputedly, the petitioner, who is arraigned as accused no.2 in the present case has no criminal antecedents. She is a married lady, aged 35 years. The material on record would go to show that, the petitioner has a son who has locomotor disability of 75%. The seized contraband article from her possession is of small quantity. She is in custody from 13.07.2026 onwards. Under the circumstances, the following :- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in Crime No.121 of 2026 registered by Hallymysore Police Station, Hassan District for offences punishable under Sections 8(C), 20(b), 20(b)(ii)(B) of NDPS Act, 1985, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless - 5 - HC-KAR CNR: KAHC010552992026 NC: 2026:KHC:45086 CRL.P No. 12272 of 2026 the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
