JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks the following reliefs: “A) Issue a Writ of mandamus by directing the Respondents to consider the representation dated 21/01/2026 vide Annexure-C given by Petitioner regarding refund of her recovered portion of Commutation of Pension. B) Grant such other relief as this Hon’ble High Court deems fit to grant under the facts and circumstances of the case including cost of this Writ Petition in the interest of justice.” - 3 - HC-KAR NC: 2026:KHC:20687 WP No. 11699 of 2026 2. Heard learned counsel for the petitioners, learned AGA for respondent Nos.1, 2, 4, 5 and 6 and learned counsel for respondent No.3 and perused the material on record. 3. It is the grievance of the petitioner that her representation dated 21.01.2026 at Annexure-C submitted to the respondents has not been considered so far by them nor any order has been passed on the same. Under these circumstances, the petitioner is before this Court by way of the present petition. 4. Per contra, learned AGA for respondents-State as well as learned counsel for respondent No.3 submit that if reasonable time is given, they would consider and pass necessary order on the said representation. 5. In view of the aforesaid facts and circumstances and rival submissions, the respondents are hereby directed to address the grievances of the petitioner and consider her representation dated 21.01.2026 at Annexure-C and pass appropriate order in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. It is further directed that till respondents consider the said representation / take appropriate - 4 - HC-KAR NC: 2026:KHC:20687 WP No. 11699 of 2026 decision / pass appropriate orders, the respondents shall not take any precipitative steps against the petitioner for recovery from the petitioner’s pension. 6.
