This is the Second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 169/2020 registered at Police Station – Pandri, District – Raipur (C.G.) for the offence punishable under Sections 341, 148, 149, 294, 323, 325, 506 and 302 of the IPC, and Sections 25 and 27 of the Arms Act.
2. Earlier the first bail application of the applicant was rejected on merits vide order dated 19.07.2022 passed in MCRC No.4603/2022.

As per the prosecution’s story, on the date of the incident i.e. 25.10.2020 at about 9.30 pm, injured Vinod Batra along with his friends was returning to Pandri Tarai after meeting one of his friends and on the way, the applicant stopped them, took the key of the scooty and started abusing. Thereafter, he called the co-accused RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 persons and thereafter assaulted Vinod Batra over his head. The friends of injured ran away from spot to save their life. Thereafter, Vinod Batra informed about the incident to one Bheemjagat who in turn reached the place of incident along with Amit Gain, Sourabh Gain and Sanjay Gain where the accused persons caught hold of Amit Gain and the applicant and co-accused persons Ashwini @ Badal Manikpuri stabbed him with knife on his stomach and right thigh, whereas other accused persons assaulted with hands and fists, clubs and bricks. Hence, this application.

Learned counsel for the applicant submits that the applicant has falsely been implicated in the present case. He submits that allegations against the applicant is false and fabricated and the injured Vinod Batra has already been examined before the trial Court. It is submitted that the knife blow was inflicted by other co- accused Ashwini @ Badal Manikpuri, who committed suicide during his judicial custody. He would further submit that there is no direct allegation levelled against the applicant. It is further submitted that three co-accused persons have been enlarged on bail vide orders dated 17.08.2021, 29.10.2021 and 25.07.2022 passed in MCRC No.4044/2021, 7959/2021 and 5144/2022. So far as the status of the trial is concerned, out of 29 witnesses, only 16 witnesses have been examined and the applicant is in jail since 28.10.2020, and the conclusion of the trial would take some time. Therefore, he prays for grant of regular bail to the applicant. 5. Learned State Counsel opposes the bail application of the present applicant and submits that the present applicant is a person who
3 had inflicted knife on the stomach of the deceased Amit Gain. It is further contended that the first bail application of the applicant was rejected on merits vide order dated 19.07.2022 passed in MCRC No.4603/2022, and though three co-accused persons have been enlarged on bail vide orders dated 17.08.2021, 29.10.2021 and 25.07.2022 passed in MCRC No.4044/2021, 7959/2021 and 5144/2022, but there was no allegation of assault using any fatal weapon against them. She would contend that as 13 witnesses are yet to be examined before the trial Court, this bail application deserves to be rejected. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7.
Considering the aforesaid facts and circumstances of the case, and the fact that the first bail application of the applicant was rejected on merits vide order dated 19.07.2022 passed in MCRC No.4603/2022; there is serious allegation against the applicant to the effect that he inflicted knife injuries over abdomen of the deceased Amit Gain; some of the witnesses have been examined but 13 witnesses are yet to be examined before the trial Court; three co-accused persons have been enlarged on bail vide orders dated 17.08.2021, 29.10.2021 and 25.07.2022 passed in MCRC No.4044/2021, 7959/2021 and 5144/2022, but there was no allegation of assault using any fatal weapon against them; therefore, I am not inclined to grant bail to the applicant at this stage. Accordingly, the instant second bail application is hereby rejected. 4
