The factual matrix as well as the core issue involved in all these writ petitions being identical, they were heard analogously and are being disposed of by this common order. For the sake of convenience, W.P. (C) No.407/2026 is treated as the lead case for adjudication of the present batch of matters, and the following reliefs have been prayed for in the said petition:- “10.1 The Hon'ble Court may kindly be pleased to issue a writ or direction, calling for the records from the concerned authorities for its kind perusal. 10.2 The Hon'ble Court may kindly be pleased to issue a writ or direction, quashing/set-aside the order dated 19.12.2025 in revision no. 13/2025 by the State Transport Appellate Tribunal Raipur so far as it relates to remitting back the matter to the RTA for fresh hearing after fulfilling the application by the respondent no.3. 4 10.3. That, the Hon'ble Court may further be pleased to stay the further proceedings of the RTA relates to rehearing of the matter as directed by the STAT as per order impugned till the nest date of hearing. 10.4 Any other relief which this Hon'ble Court may deems fit and proper looking to the facts and circumstances of the case may also be awarded to the petitioner including the cost and expenses of this petition.” 2. Learned counsel for the petitioners submits that the learned STAT has erred in remanding the matter to enable respondent No. 3 to cure the defects in the application, despite the application being incomplete on the relevant date of consideration. He further submits that the STAT has wrongly held that the vehicle proposed by respondent No. 3 was less than five years old and has misinterpreted Rule 170 of the Motor Vehicles Rules, therefore, the impugned order is contrary to law and deserves to be set aside. Lastly, he submits that the matter may be remanded to the STAT for fresh adjudication in accordance with law. 3. Learned State counsel has no objection to the prayer made by learned counsel for the petitioner. 4. The counsel appearing for the respective private respondents is also having no objection if the matter is remanded back. 5. Having considered the submissions made by learned counsel for the parties and upon perusal of the record, this Court is of the view that the impugned orders dated 19.12.2025 passed in Revision Nos. 13/2025 and 09/2025 deserve to be set aside, as such the order dated 19.12.2025 is 5 set aside. Accordingly, the matter is remitted to the STAT for fresh consideration after affording proper opportunity of hearing to the petitioner as well as respondent No. 3. Both the petitioner and respondent No. 3 – Krishna Transport Transconnect shall be at liberty to place relevant documents on record during the course of hearing and thereafter, the concerned authority shall pass an appropriate order in accordance with law. 6. The concerned petitioners are directed to appear before the STAT on 05.10.2026. Thereafter, the concerned authority shall consider the case of the petitioner, afford him an opportunity of hearing, and decide the same in accordance with law within a period of 30 days. 7.
