In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Anandapur Police Station Case No.35 of 2026 dated 25.01.2026 corresponding to charge- sheet submitted under Sections 137(2)/140(3)/64(2)(m) /65(1)/70(2)/351(2) of Bharatiya Nyaya Sanhita, 2023 and 6 of the Protection of Children from Sexual Offences Act, 2012;
XYZ Versus State of West Bengal & Anr.
Mr. Amit Ranjan Pati Ms. Swastika Chowdhury Ms. Ilika Nag Mr. Avijit Chatterjee. ...for the petitioner.
Mr. Sayan Mukherjee. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner has been implicated in the present case as he happens to be an acquaintance of the paramour of the victim.
State has produced the case diary.
I have taken into account the statement of the victim under Section 183 of the BNSS. The statement of the victim directly implicates the petitioner as one of the person ravishing her. Having considered the same, I am of the opinion that this is not a fit case for granting bail. As such, the prayer for bail of the petitioner in CRM(M)1461 of 2026 is dismissed.
Memo of Evidence as well as the report submitted by the
2 State be kept with the record.
