Ms. Tapasi Palit Sinha alongwith Mr. Mrinal Kanti Sardar who usually appear for the State and are present in Court, are requested to represent the State in the matter. Their appointments be regularized by the appropriate authority. The petitioner is directed to serve copy of the writ petition alongwith annexure thereto upon the learned counsels for the State in course of this day. The petitioner alleges that the private respondents have raised unauthorized construction without obtaining sanction from the concerned Panchayat. In reply to an application filed by the petitioner under the Right to Information Act, 2025, the Executive Assistant of the concerned Gram Panchayat has informed that no building 2 approval/permission was issued to the respondent nos.12 and 14 for raising construction in the plot in question. The petitioner submitted a representation in this regard before the concerned authority on 2nd March, 2026 which is yet to be considered. The petitioner seeks consideration of the same. Learned counsel for the respondent nos.12, 13 and 16 denies and disputes the allegation raised by the petitioner and submits that no construction has been raised by these respondents in violation of any law in force. The contention of the parties needs to be considered by the appropriate authority. Since the representation submitted by the petitioner before the concerned authority is pending, the Pradhan, Beliaberah 5 No Gram Panchayat, being the 11th respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents or any of them is found to be illegal/unauthorized, the concerned authority shall take necessary steps in accordance with law. 3 The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
