Accused in Crime No.102/2026 was registered by K.R.Sagar Police Station, Mandya District, for the offences punishable under Sections 352, 115(2), 351(2), 109, 118(1) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.102/2026 was registered by K.R.Sagar Police Station, Mandya District, for the aforesaid offences against the petitioner herein based on the first information dated 09.06.2026 received from the injured victim - Nagesh.C.S. In the said case, petitioner was arrested on 09.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5220/2026 was rejected on 03.07.2026. Therefore, petitioner is before this Court. 4. A reading of the first information would go to show that on 08.06.2026 at about 5.00 p.m., when the first informant was in Brindavan Bar & Restaurant near K.R.Sagar, accused - 3 - HC-KAR CNR: KAHC010532822026 NC: 2026:KHC:46010 CRL.P No. 11790 of 2026 and one Narasimhaswamy came to the said Bar & Restaurant. Narasimhaswamy allegedly asked the accused to return the scooter which was pledged to Vyramudi for a sum of Rs.10,000/-. At that time, complainant intervened and informed that Vyramudi was his relative. At about 5.30 p.m., Vyramudi brought the scooter which was pledged with him and accused allegedly handed over a sum of Rs.10,000/- to Vyramudi. Since the scooter was not filled with petrol, accused allegedly abused Vyramudi and when the first informant tried to intervene, petitioner allegedly after abusing him assaulted on his head with a stone and caused injuries. Learned Addl. SPP has brought to the notice of this Court that the injury suffered by the victim is simple in nature. Undisputedly, petitioner had no ill-will or motive against the victim and only in the spur of moment, he had assaulted the victim when he had tried to intervene in the quarrel between the petitioner and Vyramudi. 5. It is brought to the notice of this Court that petitioner is a person with criminal antecedents. Considering the nature of allegations found in the present case, I am of the opinion that - 4 - HC-KAR CNR: KAHC010532822026 NC: 2026:KHC:46010 CRL.P No. 11790 of 2026 petitioner's prayer for grant of regular bail is required to be answered affirmatively, subject to appropriate conditions. 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.102/2026 was registered by K.R.Sagar Police Station, Mandya District, for the offences punishable under Sections 352, 115(2), 351(2), 109, 118(1) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said - 5 - HC-KAR CNR: KAHC010532822026 NC: 2026:KHC:46010 CRL.P No. 11790 of 2026 Court until the case registered against him is disposed off; f) Petitioner shall appear before the Station House Officer of K.R.Sagar Police Station, Mandya, on every second Sunday of the month and mark his attendance between 10.00 a.m. & 1.00 p.m. for a period of six months from the date of his release from custody.
