He was transferred from Bhowali to Pithoragarh, however said transfer was cancelled on his representation, vide order dated 19.11.2025, but he has not been relieved from Pithoragarh by Chief Medical Superintendent, B.D. Pandey Hospital, Pithoragarh. By means of this writ petition, petitioner has sought the following relief: “(i) Issue a writ, order or direction in the nature of mandamus directing the Chief Medical Superintendent, B.D. Pandey Government District Hospital, Pithoragarh for relieving the Petitioner from B.D. Pande District Hospital, Pithoragarh to his original place of posting at Community Health Center, Bhowali, Nainital in the light of the communication dated 19.11.2025 (Annexure No. 5 to the writ petition) whereby the Secretary, Department of Medical Health and Family Welfare, Government of Uttarakhand has cancelled the transfer order dated 10.06.2025 (Annexure No. 2 to the writ petition).” (3) Learned State Counsel submits that petitioner has made a representation, which is on record as Annexure-6 to the writ petition. He, however, points out that petitioner should have made representation to Chief Medical Superintendent, B.D. Pandey Hospital, Pithoragarh, instead of approaching the Director General. (4) This Court finds substance in the submission made by learned State Counsel. 2026:UHC:889 Writ petition is, accordingly, disposed of with liberty to petitioner to make representation to Chief Medical Superintendent, B.D.
